The protection of your data is our concern

We are grateful for your interest in our company and our products and services and, when visiting our web pages, we want you to feel secure when it comes to the protection of your personal data. We therefore take the protection of your personal data very seriously. For us, compliance with the provisions of the EU’s General Data Protection Regulation (GDPR) and Germany’s Federal Data Protection Act (BDSG) is a matter of course.

We want you to know which data we collect, when and how we use it. We have taken technical and organisational measures to ensure that the regulations governing data protection and data security are complied with both by us and our external service providers.

(1) Information on the collection and storage of personal data

Below we outline the collection and storage of personal data when using our website. Personal data refers to all data about your identity or which can be attributed to you personally; e.g. name, address, email addresses, user behaviour and IP address.

Every time you access our website, your browser automatically transmits the data listed below to our Web server for technical reasons. The storage of this data is used exclusively for statistical and technical purposes; in order to analyse the frequency of site visits or identify faults with server operation, for example.

The following data is logged and analysed:

• Request (file name of the requested file)
• Browser type and browser version
• Operating system used
• Referrer URL; i.e. the website from which you visit our website
• IP address
• Date and time of your visit
• Web pages visited in our website
• Any form contents

Additional personal data – such as name, home address, email address, date of birth or business-transaction-related data – is only collected if you provide this yourself. On our website, you can disclose such data in the contact form, for example.

Contact via email and through the contact form

When you get in touch with us via email or through the contact form, the data you send to us (your email address, possibly your name and telephone number) is stored by us to respond to your query. We delete any data collected in this way once storing it is no longer required, or limit the processing of it if statutory retention obligations exist.

Minors under the age of 18 should not send any personal data to us without the consent of a parent or guardian. We do not request any data from children or adolescents, do not collect it and do not pass this on to third parties.

(2) The purpose of personal data and what it is processed for

We generally use the personal data provided by you to respond to your queries, process your orders or to provide you with access to certain information or offers. To nurture client relationships, it may also be necessary for us or a service provider commissioned by us to use your personal data to notify you of product offers useful for your business activities or to conduct online surveys so as to be better able to cater for the tasks and requirements of our clients.

Also, only functions and employees of ARIVA will receive your data who need it for the fulfilment of contractual, legal and supervisory obligations, as well as legitimate interests. For the technical and organisational delivery of our website, we also make use of selected order processors. All order processors are contractually obligated to treat your personal data confidentially and only to process it as part of the provision of services in line with our instructions.

We will, of course, respect your decision not to provide us with your personal data for supporting our client relationship (especially for direct marketing or for market research purposes). We will neither sell your personal data to third parties nor market it in any other way.

We will only collect, process and use the personal data supplied by you online for the purposes about which you are informed. Your personal data will not be passed on to third parties without your required consent.

Logging of email traffic

In order to ensure appropriate information and system security and to detect malware, we store log data on email traffic. When you send an email to one of our addresses, the following data is logged: email and IP address of the recipient and the sender; number of recipients; subject, date and time of receipt on our server; the file names of any attachments; the size of the message; risk classification for spam and status of delivery. In a first step, emails are checked purely in automated fashion. Only in the event of suspicion of a risk to the security of the IT systems will individual emails be manually checked by competent personnel.

If necessary, we also process your personal data relating to emails for the entire duration of the initiation of business and also in line with statutory retention and documentation obligations.

You have the following rights with respect to us concerning your personal data:
• Right to information
• Right to correction or erasure
• Right to restriction of processing
• Right to object to processing
• Right to data portability

You have the right to revoke your consent pursuant to Art. 6, Para. 1, lit. a or Art. 9, Para. 2, lit. a at any time without the legality of any processing performed until your consent was revoked being affected.

 You also have the right to complain to a data protection supervisory body about the processing of your personal data by us. (4) Transmission of applicant data

By sending us your application documents, you agree that personal data – such as name, title, address, telephone number, date of birth, education, professional experience, salary expectations – and any data or images included in the letter, CV, certificates or other sent documents will be processed by ARIVA  for the purpose of dealing with your query and expediting the application process.

If ARIVA concludes an employment contract with an applicant, the transmitted data will be stored for the purpose of expediting the employment relationship in line with statutory regulations. If no employment contract is concluded with the applicant, then the application documents will be deleted six months after a decision of rejection is announced, unless there is consent for record keeping for a period of two years as per Art. 6, Para. 1, lit. a. Your consent can be revoked at any time without providing justification through the aforementioned contact.

Data is processed based on the statutory regulations § 96, Para. 3 of the German Telecommunications Act [TKG] and Art. 6, Para. 1, lit. a (consent) and lit. b (necessity for contract fulfilment) of the GDPR.

(5) HubSpot

This website uses a HubSpot tracking code, which uses cookies or similar technologies to track visitors to this website and gather demographic information on them. HubSpot tracks the website of ARIVA and the pages you visit inside HubSpot. This data is used to deliver tailored content and promotions to users whose behaviour suggests that they may be interested in a particular topic. (6) Cookies

Our website uses so-called “cookies”. These are small text files that are stored on your terminal through the browser. They do not cause any harm.

We use cookies to make our content user-friendly. Some cookies stay on your terminal until you delete them. They enable us to recognise your browser during your next visit.

If you do not want this to happen, you can configure your browser to notify you when cookies are placed so you can permit this at your discretion in each instance.

If cookies are deactivated, the functionality of our website may be limited.

(7) SSL encryption

For security reasons, and to safeguard the transmission of confidential content – such as the queries you send to us as the website operator – this site uses SSL encryption. You can tell if a connection is encrypted if the address line in your browser changes from “http://” to “https://” and if the padlock icon is shown in the browser’s address line. When SSL encryption is activated, the data that you send to us cannot be read by third parties.

(8) Web analysis with Google Analytics

This website uses the functions of the Web analysis service Google Analytics. The provider is Google Inc., 1600 Amphitheatre Parkway Mountain View, CA 94043, USA.

Google Analytics uses so-called “cookies”. These are text files that are stored on your computer and enable your use of the website to be analysed. The information generated by the cookie about your use of this website is usually sent to a Google server in the USA and stored there.

IP anonymisation

We have activated the IP anonymisation function on this website. As a result, your IP address originating within a member state of the European Union or in other signatory states of the Agreement on the European Economic Area will be shortened prior to transmission to the USA. Only in exceptional cases will the full IP address be sent to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to analyse your use of the website, to compile reports on website activities and to render other services for the website operator associated with website usage and Internet usage. The IP address communicated by your browser as part of Google Analytics is not linked to other data from Google.

Browser plugin

You can prevent the storing of cookies by making the appropriate settings in your browser software. Demographic characteristics at Google Analytics

This website uses the “demographic characteristics” function from Google Analytics. It is used to create reports which contain information regarding the age, gender and interests of website visitors. This data originates from interest-related advertising from Google and from visitor data from third-party providers. This data cannot be attributed to a specific individual. You can deactivate this function at any time through the display settings in your Google account or stop your data from being collected by Google Analytics in general as outlined in the item “Objection to data collection”.

(9) Google reCAPTCHA

We use “Google reCAPTCHA” (hereinafter “reCAPTCHA”) on this website. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

reCAPTCHA is there to check if data entries made on this website (e.g. in the contact form) are by a human or by an automated program. To do this, reCAPTCHA analyses the behaviour of the website visitor using different characteristics. The analysis begins automatically as soon as the website visitor enters the website. To perform this analysis, reCAPTCHA evaluates various information (e.g. IP address, how long the website visitor stays on the website or mouse movements performed by the user). The data collected during the analysis is sent to Google.

The reCAPTCHA analyses run solely in the background. Website visitors are not made aware of the fact that an analysis is taking place.

Data processing is performed based on Art. 6, Para. 1, lit. f of the GDPR. The website operator has a legitimate interest in protecting its web content from misuse by automated spying and SPAM.

(10) Google Fonts

The site uses Web fonts to display text. These are provided by Google (https://fonts.google.com/).

To do this, your browser loads the required Web font into your browser cache when opening our site. This is required so that your browser can display our text with a visually optimised presentation. If your browser does not support this function, a standard font from your computer is used for the display.

(11) Google Tag Manager

We use the Google Tag Manager. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

The Google Tag Manager is a tool that we can use to integrate tracking or statistical tools and other technologies on our website. The Google Tag Manager itself does not create any user profiles, does not save any cookies and does not carry out any independent analyses. It is only used for the administration and display of the tools integrated via it. However, the Google Tag Manager records your IP address, which can also be transmitted to Google’s parent company in the United States.

The Google Tag Manager is used on the basis of Article 6 (1) (f) GDPR. The website operator has a legitimate interest in the quick and easy integration and management of various tools on its website. If a corresponding consent has been requested, the processing takes place exclusively on the basis of Article 6 (1) (a) GDPR; the consent can be revoked at any time.

Security

We have taken technical and organisational security measures to protect your personal data from loss, destruction, manipulation and unauthorised access. All of our employees and all of the third parties involved in data processing are obligated under the EU’s General Data Protection Regulation and have an obligation to treat personal data confidentially.

If personal data is collected and processed, the information is transmitted in encrypted form to prevent misuse of the data by third parties. Our security measures are being constantly updated in line with technological developments.

Changes to our privacy policy

We reserve the right to amend our security and data protection measures should technical developments require it. If this occurs, we will also amend our Privacy Notice accordingly. Therefore, please note the latest version of our Privacy Notice.
